Pen to paper for significant legal documents

Did you witness that signature?
By Mark Schadenberg
Technology is great.
However, I still remember back to a high school class (30 years ago now) where we discussed the world’s progress and I received a good chuckle from around the room when I suggested that ‘progress is garbage.’
As a quick explanation, in progress we create too many outdated machines and so much ‘yesterday’ contraptions which must find itself in some sort of compost bin.
Also, back in high school, it was discussed we could have a paperless society someday. I don’t believe that will ever be the case but moving documents around has become very efficient and very accurate. Remember the original fax paper and the idea that it arrived on a large roll almost like paper towel. The waxy shimmery paper seemingly faded in one day.
Today’s scanning and faxing machines send originals just as if they are originals.
However, as a Realtor we are not permitted to ‘witness’ someone’s signature we did not actually witness, and when filling out personal identification forms we must see the documents in person or have a ‘reliable’ third party do so.
What about buying a house and signing an Agreement of Purchase And Sale with an electronic signature? Witnessed or not I believe all signatures for most legal documents should be signed with a pen to paper.
Does anyone really know about signing under a seal ?
Read the following document below from the Real Estate Council of Ontario (RECO) which talks about provincial legislation pertaining to signing significant real estate contracts.
